Copyright & original licks

Posted: Sun May 14, 2017 7:16 am

I know this has probably been answered at some point on this board but I can't find it.

What are the restrictions behind writing a lick for a copyright piece of music (such as if I wrote a lick that went with Closer by the Chainsmokers.) Would I be able to post it on youtube? Social Media? Does anyone know?

I'd imagine the copyright issues would be similar to something like RiffTrax: you're producing original content that can be played along with a copyrighted work. I also saw this issue when drumfunny published Banished Beyond's Circle of Life. They could have the mp3s for the drumline on their website, but they didn't want to publish the combined mp3. So if you want to be safe you should just distribute the lick by itself, rather than with the original music added. That said, I don't think anyone would prosecute for this. I've seen tons of drumline stuff added to pop music on Youtube and elsewhere. As long as you aren't making money off selling the combined music I think you're fine.

Obligatory I Am Not A Lawyer: if you're really concerned, you should contact a copyright lawyer in your area. Laws vary from country to country and state to state.

As long as you're not selling the music together (if you post it on YouTube I'd be careful about monetizing that video, I honestly don't know whether or not that would be a problem) and you post a link or credits to the original song in the description you should be fine. BYOS does that sort of thing all the time and I don't think they've ever had a problem. On social media especially I really don't think you'll have a problem. I've written licks to songs before and put them on Instagram and nobody's ever sued me.
